Please read these Terms and Conditions ("Terms") carefully before using the website or services of Mr. Manatee Flooring, Cabinetry & Painting ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Acceptance of Terms

By visiting our website, submitting a quote request, or entering into a service agreement with us, you confirm that you have read, understood, and agree to these Terms and Conditions. These Terms apply to all visitors, customers, and others who access or use our services.

2. Services Provided

Mr. Manatee Flooring, Cabinetry & Painting provides flooring installation, cabinetry installation, painting, trim work, and related services to residential and commercial clients throughout Sarasota and Manatee County, Florida. The specific scope of services for any project will be outlined in a written estimate or service agreement provided prior to the commencement of work.

We reserve the right to decline any project request at our sole discretion.

3. Estimates and Quotes

All estimates and quotes provided by Mr. Manatee Flooring, Cabinetry & Painting are:

  • Based on information provided by the client and conditions observed during the in-home consultation
  • Valid for 30 days from the date of issuance unless otherwise stated
  • Subject to change if the scope of work changes or unforeseen conditions are discovered during the project
  • Not a guarantee of final cost until a written service agreement is signed by both parties

A written estimate must be accepted and a service agreement signed before any work begins.

4. Payment Terms

Payment terms will be specified in your service agreement. Generally:

  • A deposit may be required prior to scheduling or ordering materials
  • Final payment is due upon completion of the project unless otherwise agreed in writing
  • Accepted payment methods will be communicated at the time of your estimate
  • Unpaid balances past their due date may be subject to late fees or collection proceedings

We reserve the right to suspend or cease work on a project if payment obligations are not met.

5. Project Changes and Scope

Any changes to the agreed scope of work must be documented in a written change order signed by both parties before additional work is performed. Verbal change requests will not be binding. Changes to scope may affect the project timeline and total cost.

6. Client Responsibilities

To ensure a smooth and timely project, clients are responsible for:

  • Providing accurate information about the property and project requirements
  • Ensuring the work area is accessible and reasonably clear of furniture, personal belongings, and obstructions on the scheduled installation date
  • Securing pets during installation
  • Notifying us of any known hazards, including asbestos, lead paint, or moisture issues, prior to work commencing
  • Being available or designating a responsible adult to be present during the work

Delays caused by client unpreparedness may result in rescheduling fees or adjustments to the project timeline.

7. Warranties and Limitations

We stand behind our workmanship. Our labor warranty covers defects in installation for a period of one (1) year from the date of project completion, provided that:

  • The flooring, cabinetry, or painted surfaces have been maintained according to manufacturer guidelines
  • Damage is not caused by misuse, abuse, flooding, structural movement, or other conditions beyond our control
  • The client notifies us in writing of any defect within the warranty period

Product warranties (for flooring materials, cabinet components, and paint products) are governed by the respective manufacturers and are separate from our labor warranty. We will assist clients in understanding and submitting manufacturer warranty claims where applicable.

We make no warranties beyond those expressly stated herein. All implied warranties, including implied warranties of merchantability or fitness for a particular purpose, are disclaimed to the fullest extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Mr. Manatee Flooring, Cabinetry & Painting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or these Terms, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of a project shall not exceed the total amount paid by the client for that specific project.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and design elements, is the property of Mr. Manatee Flooring, Cabinetry & Painting and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from our website without our express written permission.

10. Dispute Resolution

In the event of a dispute arising out of or relating to our services or these Terms, the parties agree to first attempt to resolve the dispute informally by contacting us directly. If the dispute cannot be resolved informally within 30 days, both parties agree to submit to binding arbitration in Sarasota County, Florida, in accordance with the rules of the American Arbitration Association.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Sarasota County, Florida.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.
